On 10 June 2021, the <\/span>Privacy Guarantor <\/b>has issued a provision that will oblige all website owners to comply with <\/span>new guidelines on cookies and other tracking tools<\/span><\/a>.<\/span><\/p>\n

The intent is to provide clearer and more specific rules on <\/span>method of transmission of the information<\/b> and, above all, on <\/span>method of acquiring consent<\/b> of users who visit a website.<\/span><\/p>\n

All interested parties will have to adapt by <\/span>January 9, 2022<\/b>. There is no time to lose.\u00a0<\/span><\/p>\n

What are cookies?<\/b><\/h3>\n

When we talk about <\/span>Cookies<\/b><\/a>, we mean simple text strings that are saved on a user's device each time the latter visits a new website.\u00a0<\/span><\/p>\n

The use of <\/span>Cookies <\/b>allows the storage of some information about the user, such as, for example, login credentials, preferred language or personal preferences.\u00a0<\/span><\/p>\n

In this way, the subject does not have to enter a username and password every time he visits a site he frequently visits and, at the same time, the website managers obtain information about their regular visitors.<\/span><\/p>\n

In addition to keeping track of users who have already visited the site, i <\/span>Cookies <\/b>they are also used as tools to obtain and store information of various kinds, regarding the <\/span>behavior <\/b>of a user on the web. The collected data is then generally used for advertising purposes.<\/span><\/p>\n

For this reason, today it is necessary that the websites that operate this tracking request the consent of the interested party. Those who surf the web will certainly have noticed that, upon entering a site, they are often greeted by a pop-up (<\/span>banner) <\/b>that informs (<\/span>informative<\/b>) on the presence of <\/span>Cookies <\/b>and requires permission for installation.<\/span><\/p>\n

However, this only involves a part of the <\/span>Cookies<\/b>. Since, as we will see in the next chapter, there are different types.<\/span><\/p>\n

Types of cookies<\/b><\/h3>\n

Without going into excessively technical details, we can say that i <\/span>Cookies <\/b>they are divided into two main categories: i <\/span>technical cookies <\/b>ei <\/span>profiling cookies<\/b>.\u00a0<\/span><\/p>\n

Technical cookies<\/span><\/h4>\n

They are necessary for the proper functioning of the site. They are useful for storing time-saving information for the user, such as the credential storage mentioned above.\u00a0<\/span><\/p>\n

Being considered indispensable, they do not require the acquisition of the user's consent, but must in any case be indicated in the information.\u00a0<\/span><\/p>\n

Profiling cookies<\/span><\/h4>\n

As the name suggests, i <\/span>profiling cookies<\/b> they are used to recognize patterns of behavior, habits and preferences of visitors to a website.\u00a0<\/span><\/p>\n

Knowing the exact behavior of their users allows website managers to provide a personalized service based on their customers, to send <\/span>advertising campaigns<\/b> targeted and, in general, to improve the service offered.\u00a0<\/span><\/p>\n

THE <\/span>profiling cookies<\/b>, since they are not essential, they require the informed consent of the parties directly concerned.\u00a0<\/span><\/p>\n

What changes?<\/b><\/h3>\n

The standard currently in force is the <\/span>directive 2002\/58 \/ EC<\/span><\/i> of 12 July 2002 issued by the European Parliament, also called <\/span>ePrivacy<\/b>, in combination with the <\/span>Regulation (EU) no. 2016\/679<\/span><\/i> of the European Commission, also called <\/span>general data protection regulation<\/b> or <\/span>GDPR<\/b>.<\/span><\/p>\n

The new guidelines introduced by the Guarantor are intended to put the user in a position to be able to decide on the installation of <\/span>Cookies <\/b>in full awareness, thanks to clear and precise information.\u00a0<\/span><\/p>\n

If previously the <\/span>banner <\/b>that welcomes new visitors to the site did not have to meet specific requirements, with the new rules it must have a size, color or other distinctive characteristics such as to be immediately visible.\u00a0<\/span><\/p>\n

\"Digife<\/span><\/p>\n

Note that i <\/span>technical cookies<\/b>, for which only their presence in the information will continue to be necessary. Therefore, on the first access of a new device, websites will not be able to install it <\/span>Cookies<\/b>, if not technical.<\/span><\/p>\n

As for the <\/span>profiling cookies<\/b>instead, they must be present in the banner and will need the <\/span>explicit consent of the user<\/b>, before their installation.<\/span><\/p>\n

This last point represents a cornerstone of the new provision. Consent to profiling must be provided in such a way <\/span>clear and unambiguous<\/b>. This means that the user must actively click a button to accept.\u00a0<\/span><\/p>\n

Simple "silent assent" will no longer suffice.<\/span><\/h4>\n

The Guarantor then indicates some precise characteristics that the banner area must have:<\/span><\/p>\n
