{"id":27180,"date":"2017-03-08T11:38:09","date_gmt":"2017-03-08T11:38:09","guid":{"rendered":"https:\/\/www.digife.it\/?p=27180"},"modified":"2017-03-08T11:40:11","modified_gmt":"2017-03-08T11:40:11","slug":"facebook-arrives-the-condemnation-of-having-copied-unapp-italiana","status":"publish","type":"post","link":"https:\/\/www.digife.it\/en\/facebook-arrives-the-condemnation-of-having-copied-unapp-italiana\/","title":{"rendered":"Facebook: conviction arrives for copying an App. Italian"},"content":{"rendered":"<p>Facebook copies an app. Italian and the sentence arrives<\/p>\n<p>For the first time the Colossus <b>by Zuckerberg<\/b>\u00a0<strong>was convicted in Italy for unfair competition and copyright infringement.<\/strong><\/p>\n<p>With sentence no. 9549 of 1 August 2016, the Section Specialized in the field of Business of the Court of Milan has ascertained the liability of the companies <strong>Facebook<\/strong> Srl, <strong>Facebook<\/strong> Inc. and <strong>Facebook<\/strong> Ireland LTD for <strong>acts of unfair competition against Business Competence Srl<\/strong>. and for <strong>violations of copyright<\/strong> on the database represented by the application &quot;<strong>Faround<\/strong>&quot;Of the same <strong>Business Competence Srl<\/strong><\/p>\n<p>With this ruling, the Court of Milan prohibited the three companies of the Facebook group from any further use of the application called &quot;<strong>Nearby<\/strong>\u201dFor the Italian territory and ordered the publication of the provision in the two national newspapers,\u201c Corriere della Sera \u201dand\u201c Il Sole 24 Ore \u201dand, for at least fifteen days, on the home page of the Facebook website.<\/p>\n<p><strong>The sentence, not yet final,<\/strong> was challenged by <strong>Facebook<\/strong> before the Court of Appeal of Milan.<\/p>\n<p>For this the Italian users of\u00a0<strong style=\"font-style: inherit;\">Facebook<\/strong>, very soon, they may no longer find the functionality &quot;<strong>Nearby<\/strong>&quot; or &quot;<strong>Friends nearby<\/strong>\u201c, Within the application of the\u00a0<strong style=\"font-style: inherit;\">social network<\/strong>.<\/p>\n<p><strong>Nearby<\/strong> is that feature that can allow, if activated, to find out which friends contacts are closest to your position thanks to the use of the GPS present in your device.<\/p>\n<p>The story dates back to 2012 when the Italian startup, Business Competence Srl, submitted to <strong>Facebook <\/strong>for his approval an app called\u00a0<strong style=\"font-style: inherit;\">Faround<\/strong><strong>.<\/strong><\/p>\n<p><b>Zuckerberg&#039;s company<\/b>, however, he never replied to Business Competence and indeed, a few months later he formalized the introduction of the Nearby function, which offered the same functions as the App. of the Italian company, that is, to identify friends in the vicinity.<\/p>\n<p>The Court of Milan not only recognized the rights of\u00a0<strong style=\"font-style: inherit;\">Business Competence<\/strong>, but also ordered the social network to remove the Nearby application within the Italian territory.<\/p>\n<p><strong>Next April 4th in Milan<\/strong>, before the first Civil Court of Appeal, the second degree case on the merits will be held against the companies of the group\u00a0<strong>Facebook<\/strong> who, while respecting and adhering to the provisions of the judicial authority, appealed, arguing that the disputed is without foundation.<\/p>\n<p><strong>Nearby<\/strong> it is not among the most used functions of the social network and, probably, before this case became known, not everyone knew it but, surely, there will be those who will suffer from having been deprived of the function.<\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Facebook copies an app. Italian and the sentence arrives For the first time the Colossus of Zuckerberg has been convicted in Italy for unfair competition and copyright infringement.
